Privacy Policy
This policy explains how Flex 54 collects, uses and protects information when you visit our website, create an account or use our services.
1. OVERVIEW
Flex 54 is a product operated by 26th Street Inc. References to “Flex 54,” “we,” “us” or “our” mean 26th Street Inc. and its relevant affiliates. Flex 54 provides AI-assisted websites, unified inbox, customer communications, lead capture, handoff routing, invoicing, knowledge-base tools and related business software for small and growing businesses.
This Privacy Policy explains how we collect, process, store, use and share information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a person or household (“Personal Information”). Personal Information does not include anonymous, deidentified or aggregated data that cannot reasonably identify a person.
This policy applies to our website, product dashboard, widgets, connected-channel features and other services. It does not govern how a Flex 54 customer uses Personal Information in its own business. If you communicate with a business using Flex 54, that business may be the controller or owner of your Personal Information and may have its own privacy obligations.
2. INFORMATION WE COLLECT
We may collect account and identity information, such as name, email address, phone number, organization, role, authentication credentials, billing contact details and business profile information.
We may collect business content and customer communications that you choose to provide or connect, including website content, business knowledge, FAQs, product or service details, customer enquiries, leads, contact fields, invoices, attachments, notes, conversation history, handoff requests and team activity.
We may collect technical and usage information, including IP address, browser and device information, operating system, referral source, pages viewed, feature usage, log data, approximate location derived from IP address, crash data, diagnostic data, cookies and similar technologies.
We may collect payment and subscription information through our payment processors. We do not intentionally store full payment card numbers in Flex 54.
3. SOURCES OF INFORMATION
We collect information directly from you when you create an account, configure your business, upload files, invite team members, publish a website, create invoices, use chat or support, or otherwise communicate with us.
We collect information from connected services you authorize, such as email, messaging, social-media, website, payment, hosting or analytics providers. We collect only the information needed to provide the connected feature you choose to use.
We may receive information from your team members, your customers, service providers, integration partners, analytics providers, fraud-prevention vendors and other lawful sources.
4. HOW WE USE INFORMATION
5. AI AND CUSTOMER COMMUNICATIONS
Flex 54 uses artificial intelligence to help businesses draft or send responses, organize enquiries, summarize conversations, capture leads, enrich business websites and route conversations. Customers control the business knowledge, channels and team access they connect.
You may communicate with AI-powered bots when using Flex 54 or when contacting a business through a Flex 54-powered widget or connected channel. Communications made through the services, including email, text, social messages, webchat and related metadata, may be monitored, recorded and used for the purposes described in this policy.
AI-generated content may be incomplete, inaccurate or unsuitable for a particular situation. Businesses remain responsible for reviewing important customer communications, configuring human oversight where appropriate and keeping their knowledge current.
6. GOOGLE WORKSPACE DATA AND AI PROCESSING
Flex 54 uses Google Workspace API data only to provide user-facing features requested by the user, including displaying connected email conversations, synchronising email threads, classifying and summarising messages, generating suggested responses, capturing customer enquiries, and sending authorised replies from the user’s connected Gmail account.
Flex 54 uses Google Gemma, an open-weight artificial intelligence model that is self-hosted and operated by Flex 54 using vLLM within Flex-controlled Google Cloud infrastructure. Google Workspace data is processed within this isolated infrastructure and is not transmitted to Google’s hosted Gemini API, OpenAI, Anthropic, or any other third-party hosted AI service.
Flex 54 does not use raw, aggregated, anonymised, or derived Google Workspace data to train, fine-tune, create, or improve any foundational or general-purpose artificial intelligence or machine-learning model. Google Workspace data is not sold, used for advertising, or shared with data brokers.
Google Workspace data is processed only to provide the connected business with the visible features of the Flex Unified Inbox and AI customer-operations workspace.
The use of information received from Google Workspace APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
7. HOW WE SHARE INFORMATION
We do not sell Personal Information. We may share information with vendors and service providers that help us host, secure, analyze, communicate, process payments, provide customer support, operate integrations and deliver Flex 54, subject to appropriate contractual, confidentiality and data-protection obligations.
We may share information with the business customer that owns or controls the relevant workspace, website, widget, inbox, invoice or connected channel. Team members invited to a business workspace may see information according to their permissions.
We may share information with third parties you access, authorize or authenticate through the services, including channel providers, payment processors, website tools and other integrations. Your use of those third-party services is also subject to their terms and privacy policies.
We may disclose information where required by law, legal process or governmental request; to enforce our agreements; to protect rights, safety, privacy or property; to prevent fraud or abuse; or in connection with a merger, acquisition, financing, reorganization, bankruptcy or sale of assets.
8. RETENTION AND SECURITY
We retain information for as long as reasonably necessary to provide the services, maintain business records, comply with legal obligations, resolve disputes, enforce agreements, secure the platform and support legitimate business purposes. Retention periods may vary based on the type of information and the customer’s configuration.
We use administrative, technical and organizational safeguards designed to protect information, including access controls and security monitoring. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. COOKIES AND SIMILAR TECHNOLOGIES
We use cookies, local storage, pixels, log files and similar technologies to operate the website and product, keep users signed in, remember preferences, understand usage, detect abuse and improve performance.
Some browsers offer “Do Not Track” signals. Our services are not currently configured to respond to Do Not Track signals. You can control cookies through your browser settings, but disabling some cookies may affect service functionality.
10. YOUR CHOICES AND RIGHTS
Depending on where you live, you may have rights to access, correct, delete, restrict or export Personal Information, object to certain processing, withdraw consent, appeal a decision or opt out of certain sharing or automated decision-making. These rights may be limited by applicable law and by the rights and obligations of the business customer that controls the relevant data.
To make a privacy request, contact help@flex54.com. We may need to verify your identity and authority before responding. If your request concerns information controlled by a Flex 54 customer, we may direct you to that customer or support that customer in responding.
You may unsubscribe from marketing emails using the unsubscribe link in those emails. You may manage or disconnect certain integrations from your account settings or the connected service, subject to product availability.
11. INTERNATIONAL PROCESSING
Flex 54 and its service providers may process and store information in countries other than where you live. Where required, we use appropriate safeguards for cross-border transfers.
12. CHILDREN
Flex 54 is a business service and is not directed to children. You must be at least 18 years old to create an account. We do not knowingly collect Personal Information from children where parental consent would be required. If you believe a child provided information to us, contact us so we can take appropriate action.
13. CHANGES TO THIS POLICY
We may update this Privacy Policy to reflect changes to our services, legal obligations or data practices. We will post the updated policy with a new effective date and provide additional notice when appropriate. Continued use after the effective date means the updated policy applies.
