These terms govern your use of the Flex54 website, waitlist and services. By accessing or using Flex54, you agree to these terms.

1. About Flex54

Flex54 is a product operated by 26th Street Inc. Flex54 provides AI-assisted websites, customer communications, lead management, knowledge tools and related business software. Some features described on this website are planned or available only to selected early-access users.

2. Eligibility and authority

You must be legally able to enter into a binding agreement. If you use Flex54 for an organization, you confirm that you have authority to accept these terms for that organization.

3. Waitlist and early access

Joining the waitlist does not guarantee access, a launch date, pricing or availability in a particular market. We may invite participants based on product readiness, market, business fit and capacity. Early-access features may change, contain errors or be discontinued.

4. Accounts and connected services

You are responsible for accurate account information, authorized users and safeguarding credentials. You may connect only channels, accounts, data and business assets that you own or are authorized to manage. Your use of third-party channels also remains subject to their terms and policies.

5. Acceptable use

You may not use Flex54 to violate law, infringe rights, deceive or harass people, distribute harmful software, send unlawful spam, evade platform restrictions, gain unauthorized access, or process data without a lawful basis. You may not reverse engineer, disrupt or misuse our services except where such restriction is prohibited by law.

6. AI-assisted features

AI output may be incomplete, inaccurate or unsuitable for a particular situation. You are responsible for your business communications, decisions and regulatory obligations. You should review important responses and use human oversight for sensitive, regulated or high-impact matters. Flex54 does not provide legal, financial, medical or other professional advice.

7. Your content

You retain ownership of content and data you submit. You grant us the limited rights necessary to host, process, transmit and display that content to provide and secure Flex54. You confirm that you have the required rights, notices and permissions for the data you provide or connect.

8. Our services and intellectual property

Flex54, its software, design, trademarks and related materials are owned by 26th Street Inc. or its licensors. Except for the limited right to use the services under these terms, no intellectual-property rights are transferred to you.

9. Fees

Waitlist registration is free. If paid services become available, applicable pricing, billing terms and taxes will be shown before purchase or set out in a separate order. We may change future pricing with appropriate notice.

10. Privacy

Our Privacy Policy explains how we collect, use and protect personal information. You are responsible for providing any notices and obtaining any permissions required for your own customers and connected channels.

11. Suspension and termination

You may stop using Flex54 at any time. We may limit or suspend access to protect users, comply with law, address security risks, prevent misuse or enforce these terms. Where reasonable, we will provide notice and an opportunity to resolve the issue.

12. Disclaimers

To the extent permitted by law, Flex54 is provided “as is” and “as available.” We do not guarantee uninterrupted operation, a specific business outcome, error-free AI output or compatibility with every third-party service.

13. Limitation of liability

To the extent permitted by law, 26th Street Inc. and its affiliates will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data, goodwill or business opportunity arising from use of Flex54. Any aggregate liability will be limited to the greater of the amount paid for the service during the previous twelve months or the minimum amount required by applicable law.

14. Changes

We may update these terms to reflect changes to our services or legal requirements. Material changes will be communicated where appropriate. Continued use after the effective date means you accept the updated terms.
